ScanPlanHVAC for iOS • Effective Date: May 28, 2026

ScanPlanHVAC ("the App") is an HVAC load calculation, floor plan, and building analysis tool that leverages your device's LiDAR sensor, spatial mapping services, and external meteorological data. By installing or utilizing the App, you agree to comply with and be bound by these Terms of Service.

1. Description of Service

The App enables professionals and technical users to scan physical building interiors, compile floor plan layouts, measure structural surfaces, resolve spatial location details via mapping APIs, and perform engineering-based HVAC heat loss, heat gain, and energy modeling projections.

1.5 Subscriptions, Purchases, and Cancellations

The App offers an auto-renewing subscription tier ("ScanPlan Pro Monthly") to unlock unlimited project capacities, advanced material scans, and professional PDF report exports.

Subscription Terms: ScanPlan Pro Monthly is billed on a monthly cycle at $25.00/month (or local currency equivalent resolved by Apple).
Free Trial: Your subscription includes a 7-day free trial. If you do not cancel at least 24 hours prior to the expiration of the 7-day period, your Apple ID account will be charged $25.00, and the trial will automatically transition into a paid monthly subscription.
Payment: Payment is processed securely via your Apple ID / iTunes Account at the confirmation of purchase.
Automatic Renewal: The subscription automatically renews at the end of each billing cycle unless auto-renew is turned off inside your App Store Account settings at least 24 hours before the current period ends.
Renewal Charges: Your account will be charged for renewal within 24 hours prior to the close of the current period at the rate of $25.00/month.
Management & Cancellations: You can cancel, review, or modify your subscription at any time via your iOS Settings (Settings > [Your Name] > Subscriptions). Refunds and billing inquiries are handled exclusively by Apple.

2. Use at Your Own Risk

All measurements, thermal load calculations, projections, fuel cost comparisons, and generated PDF reports are mathematical approximations for informational and planning purposes only. They do not constitute certified mechanical engineering diagrams or formal regulatory approvals.

You are solely responsible for manually verifying and double-checking all App metrics before making any purchasing, construction, permitting, or HVAC equipment installation decisions.

3. Acceptable Use

You agree not to:

Decompile, reverse-engineer, or attempt to extract the source code of the App.
Deploy the App in any illegal, fraudulent, or unauthorized commercial manner.
Redistribute, sublicense, or resell individual App outputs or access privileges.
Interfere with or attempt to disrupt the servers, networks, or APIs supporting the App.

4. Intellectual Property

All intellectual property rights associated with the design, algorithms, models, code, and graphical branding of ScanPlanHVAC are owned exclusively by the developer.

All spatial project files, measurement data, floor plans, and PDF reports created by you remain your sole property.

5. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or accuracy of data.

6. Limitation of Liability

To the maximum extent permitted by applicable law, the developer shall not be liable for any direct, indirect, incidental, or consequential damages resulting from the use of, or inability to use, the App. This includes, without limitation, incorrect heating or cooling calculations, structural measurement errors, equipment selection mismatches, or project delays.

7. Changes to These Terms

We reserve the right to revise or update these Terms of Service at any time. Continued use of the App following any updates constitutes complete acceptance of the revised Terms.

8. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of Maine, United States, without regard to its conflict of law principles.
